According to Virginia law, every employer who regularly employs two or more full-time or part-time employees is required to carry Workers' Compensation Insurance. If you have fewer than two employees, coverage is optional.

  • Sole proprietors, partners, and LLC members are excluded from compulsory coverage, but may elect to cover themselves with their Workers' Comp policy.
  • Independent contractors are not automatically eligible for Workers' Compensation.
    • If the independent contractor employs two or more regular full- or part-time employees, those workers are eligible for coverage.
  • Coverage must be provided through self-insurance (for qualifying companies) or purchased through a commercial insurance carrier.
