NORTH DAKOTA WORKERS' COMPENSATION LAW REVIEW
North Dakota law requires all employers to purchase Workers' Compensation Insurance for their employees (part-time, full-time, seasonal, or otherwise) prior to hiring.
ND Workers' Comp: Key Details
- Sole proprietors, partners, and corporate officers of North Dakota businesses can cover themselves; however, they may also elect not to.
- Coverage is mandatory for all businesses, except for:
- Farm and ranch labor, certain custom operations, household domestic workers, and employees engaged in the operation of a place of worship.
- Independent contractors. To be considered an independent contractor, you may need to complete an Independent Contractor Verification Application. Once approved, you will be exempt from carrying Workers' Compensation.
- Federal and railroad employees.
- Children of the employer who are under the age of 22.
- North Dakota runs a monopolistic state insurance fund. In other words, you can only purchase coverage through the state. Self-insurance and private insurance are not permitted. This means Insureon can't sell Workers' Comp policies to ND-based employers.
